This is incorrect. Your warranty coverage IS contingent on the battery check. Per page 9 of the 2021 Nissan Leaf Warranty Booklet: To maintain warranty coverage you are required to perform annual battery maintenance checks at 12, 24, 36, 48, 60, 72 and 84 months. The check can be done at either a Nissan dealer or qualified repair shop facility.
As u/XavvenFayne says, the warranty doesn't kick in until you've lost the 9th bar. But if this is a 30KWh battery make sure you got the software update because the original software calculates the capacity wrong. If you don't have the update you'll likely go back to 10 bars. Otherwise, yeah, seems you're on track for a warranty replacement.
